Posted by u/Few-Criticism-9114 12 hours ago Suspended for no reason I bartend at a hotel, where throughout the week I rotate between 3 bars.

There's a member on our bar roster who seems to always be starting problems with literally every one of the bartenders as well as the management team. He's been so problematic that most of the bartenders refuse to work with him. I

have never had an issue with him, in fact, I often have agreed to swap shifts with people who would otherwise be scheduled with him. All of what I have heard from the others has always involved a verbal altercation with yelling and

cursing. I have never experienced this with anyone at work, let alone him. But apparently his mom works for our HR department and that's why he gets away with murder.

Last Monday, I swapped shifts with someone and worked with him since we're cool (so I thought). He was the mid, I was the closer. So when I got there, we shook hands. Shift was fine, seemed like a normal day,

we were chatting it up since it was super slow, laughing, cracking jokes. He stayed way longer than necessary, but I didn't care. End of his shift, I shake his hand and he leaves. Not once was there any form of altercation. Nothing negative was exchanged, in

fact all of our were positive and light. conversations Following Wednesday, I get called into HR office before starting my shift. Apparently he filed a complaint against me, stating that I "punched him and cursed him out". ?????
  • 09
I was so confused. I wrote my statement and explained that his complaint isn't just an exaggeration, it's completely made up. Mind you, we have about 8 cameras on us at the bar, plus if that really happened,

why was nothing said until the following day? they Nonetheless, suspended me and I've yet to hear from them about whether I still have my job or not. None of this makes sense.
  • 11
Edit: I just received a call from them. (It's a big company, so the call was with 3 of the upper management for our location specifically). They informed me that I have a green light to return to work tomorrow and that I will be paid for the hours I missed out on at minimum wage
  • 12
(given that otherwise I'm typically paid "server wages"). They did say that they are still investigating and that I am not "permitted" to speak to anyone else about it. Not sure how I feel about this. Management and HR have all been kind and respectful, nonetheless the situation is ridiculous.

mu missanthrope21. 10 hr. ago Sounds like a nice lawsuit in the making...

Kips Bay2181. 6 hr. ago Can you escalate beyond HR? Or Is the hotel GM also part of that family?
  • 15
With regard to lawsuits: Unless you were working under a Union contract or otherwise mutually signed employment agreement that this suspension violates, you don't have any grounds for a lawsuit against the company.
  • 16
Most of the US, if that's where you are, is what's called "at will employment". And in those States you can be terminated for any reason (other than for gender, religion, etc, but nearly impossible to prove). Bottom line, HR can just fire you to make this go away.
  • 17
You actually could probably gin up a decent suit for defamation and slander against the guy, given the loss of income that's a direct result of his lie. If of course you can prove there was no fight. If

HR is that corrupt, I wouldn't count on the security camera footage still being there. But he's not going to have any assets to go after. A Judgment against him would be
  • 19
satisfying but prob wouldn't translate to lots of money coming to you. Unless maybe. you can rope the HR lady into the lawsuit, as his co conspirator.
  • 20
I think what I would do is pay a lawyer to write a letter that tells them to preserve all security camera records. Stop all communication with them, once a lawyer is involved only the lawyer talks to them.
  • 21
Scare the it out of them, and then get your lawyer to ask for your lost wages, your legal fees, and a good recommendation letter, in exchange for not suing them. No matter what, you need to find a better place to work.
